Certified legal digitisation with Snap&Scan

This specific annex to our main Privacy Policy provides additional informative context on the data processing we carry out for the provision of electronic certification services.

ANF Autoridad de Certificación [ANF AC], is the owner of the Legal Snap Scan ® application, solution approved by Resolution of the Director of the Department of Tax Information Technology of the AEAT dated 26.11.2007, with reference 0B1F56D5A8E90CBB and its update version 2.1 (23.10.2017), in accordance with the Order EHA 962/2007 and the Resolution of 24 October 2007 of the AEAT.

The Legal Snap Scan® certified digitisation system has the mandatory Quality Management Plan that has been approved by AEAT, this plan is drawn up in accordance with tax regulations to be accepted by users and entities that participate in the certified dematerialisation process.

Legal Snap Scan® has been designed and developed in accordance with the requirements established in the General Data Protection Regulation (EU) 2016/679 and the Organic Law 3/2018 on Data Protection and Guarantees of Digital Rights of Spain, having an Impact Assessment on data protection. And, given that the Legal Snap Scan ® system uses qualified electronic signature certificates, it complies with current legislation on identification, electronic signature and trust services; ANF AC has the technical capacity and official accreditation required to issue qualified electronic signature certificates, issue qualified electronic time stamps, manage and protect signature creation data created, stored or processed with signature creation devices of long validity. All this in accordance with ETSI EN standards, Regulation (EU) 910/ 2014 eIDAS, and Spanish Law 59/2003 on Electronic Signature.

ANF AC, in order to provide its Legal Snap Scan® service with greater scope, has designed a method (patent pending) whose objective is to enable the deduction of VAT from simplified invoices that have initially been prepared by automated equipment that does not include all the data required to enable the deduction. The method developed complies scrupulously with Law 37/1992, of 28 December, on Value Added Tax, and Invoicing Regulations developed in Royal Decree 1619/2012, of 30 November, articles 2, 6, 7, 8, 9.

The Legal Snap Scan® application includes the fiscal processing of the data by means of a database that keeps the data in a structured form in accordance with the provisions of Law 37/1992, and the obligatory platform for accessing the information for tax inspection purposes.

In any of the above cases, simple de-materialisation of documents, or complemented with the deduction of VAT, ANF AC carries out a data processing of expenses incurred by individuals Although such processing does not include the name and surname of the person concerned, nor identity card, it does include employee identification of the contracting company, so that the contracting company can identify each expense to a specific individual.

ANF AC, provides this service as a data processor, having formalised with each contracting company the corresponding contractual document as data processor.

Before collecting your data, you will be informed of your rights, how to exercise them and other information required by the relevant legislation, and other rules and standards with which compliance is required in the field of electronic certification.

ANF AC
is obliged to carry out checks with third party information sources in order to carry out the necessary checks to ensure the reliability and accuracy of the information you have provided. In the development of these consultations, documentary and informative evidence is collected to accredit the correct fulfilment of our obligations.

Conservation
The retention period is the duration of the service provision contract, and during the period that ANF AC needs to accredit the proper performance of its services.

Recipients
Except in the cases set out in the main Privacy Policy, ANF AC does not transfer the data to third parties.
