As of April 3, 2025, Organic Law 1/2025 (of January 2) takes effect, introducing Appropriate Means of Dispute Resolution (MASC) as a mandatory requirement in civil and commercial proceedings.
What are MASC?
MASC are extrajudicial negotiation and dispute resolution mechanisms. Their goal is to try to reach an agreement before resorting to courts, bringing greater efficiency, agility, and cost reduction.
Key innovations of Law 1/2025
Procedural requirement
It will be mandatory to demonstrate an attempt at MASC before filing a lawsuit.
Confidential binding offer
A new type of MASC that remains confidential until accepted, and legally binds the party that makes it.
Legal effects
Initiating a MASC interrupts the statute of limitations and suspends the expiry of legal actions.
